These Terms of Use (“Terms”) govern your use of sparkshutter.com (the “Site”), operated by SparkShutter (“SparkShutter,” “we,” “us,” or “our”), owned and operated by Marc Anderson in Barrie, Ontario, Canada.
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
SparkShutter is a wedding venue discovery directory. We publish information, photos, and videos about wedding venues and help couples send inquiries to venues they are interested in.
SparkShutter is not a wedding venue, event planner, or booking agent. We do not book, sell, or guarantee any venue’s services. Any agreement you make with a venue, including pricing, deposits, contracts, cancellations, and refunds, is strictly between you and that venue. SparkShutter is not a party to that agreement and is not responsible for a venue’s services, conduct, or performance.
We work to keep venue information accurate and current, but details such as pricing, capacity, availability, amenities, policies, and photos can change without notice and may not reflect a venue’s current offering. Pricing shown on the Site is for general guidance only.
Always confirm all details directly with the venue before making any decisions or payments. SparkShutter does not guarantee the accuracy, completeness, or availability of any venue information on the Site.
Unless a page clearly states otherwise, a venue’s appearance on the Site does not mean that venue endorses SparkShutter or has a business relationship with us.
When you submit an inquiry through the Site, you agree to provide accurate information and to use the inquiry forms only for genuine wedding or event inquiries. Your inquiry will be shared with the venue you contacted, as described in our Privacy Policy.
We do not guarantee that a venue will respond to your inquiry, or how quickly it will respond.
All content on the Site, including photographs, videos, drone footage, text, graphics, logos, page designs, and the SparkShutter name, is owned by SparkShutter or used with permission, and is protected by Canadian and international copyright and trademark laws.
You may view and share links to pages on the Site for personal, non-commercial purposes. You may not copy, download, reproduce, republish, edit, or distribute any photos, videos, or other content from the Site without our prior written permission.
If you would like to use any of our content, including venues wishing to use photos or videos of their own property, please contact us. We review permission requests on a case-by-case basis.
When using the Site, you agree not to:
We may block access to the Site for anyone who violates these Terms.
If you own or represent a venue listed on the Site and want your listing corrected, updated, or removed, please contact us and we will review your request promptly.
Any additional services we may offer to venues in the future will be governed by separate terms agreed with each venue.
The Site may contain links to venue websites, social media pages, maps, and other third-party sites or embedded content. These are provided for convenience only. We do not control and are not responsible for third-party sites, their content, or their privacy practices.
The Site and all content on it are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose, or uninterrupted availability. We do not guarantee that the Site will be error-free, secure, or always available.
To the fullest extent permitted by law, SparkShutter and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of money, deposits, bookings, data, or opportunities, arising from or related to your use of the Site, your reliance on any information on the Site, or your dealings with any venue.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be waived or limited.
You agree to indemnify and hold harmless SparkShutter and its owner from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Site or your violation of these Terms.
Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use personal information.
We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Continued use of the Site after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute relating to these Terms or the Site will be handled exclusively by the courts of Ontario.
